These terms and conditions relate to items supplied to you through this Site by Rich Mix ("we" or "us") to you, the customer or Site user ("you"). This Site is provided to you subject to these terms and conditions. By using the Site you agree to be bound by these terms and conditions.
1 Purchasing tickets online
1.1 There are no rights of refund or exchange and you acknowledge that the cancellation rights contained in the Consumer Protection (Distance Selling) Regulations 2000 (as amended) do not apply to the services we offer.
1.2 The prices of the tickets are those displayed on the Site from time to time, during the ordering process, except in cases of obvious error. In addition to the ticket price a card handling fee (for processing your credit/debit card transaction with our bankers), is payable and this will be notified to you during the ordering process. All prices and fees include any applicable Value Added Tax. Prices are in pounds sterling.
1.3 Remote payment can be made by any method specified in the FAQs. We will deduct your payment from your card at the time it processes your credit/debit card transaction. You cannot use promotional vouchers, discount cards or complimentary passes in conjunction with a ticket purchase via this Site. (If you wish to do this, you will need to visit us in person. Please see the terms and conditions on promotion, voucher or pass). If you are a student, you can still benefit from the student price, but you must bring your proof of student identity when you collect your ticket (see the FAQs for details of the type of proof we accept).
1.5 The sale of tickets is subject to availability. Your order for a ticket is an offer to purchase a ticket from us, and we retain the right to refuse your order. If we accept your order we will display a confirmation page on your screen at the end of the ordering process, and at this point there will be a contract. We will also send you an e-mail confirmation of your completed order, for your information. We do not file details of your order for you to access on this Site. We recommend that you print out a copy of the confirmation page and/or confirmation e-mail for your records.
1.6 Tickets can be collected from the box office or ATMs (where available) when your credit/debit card transaction and the entire ordering process has been completed. For security reasons, the cardholder must be present to collect the tickets, and you will need to take the same card as you used to make your booking.
1.7 We are not under an obligation to provide the tickets to you at an incorrect (lower) price, even after the confirmation page has been displayed and the confirmation email has been sent to you if such a pricing error is obvious and unmistakable and could have reasonably been recognised by you as mis-pricing.
1.8 Price and availability information is subject to change without notice.
1.9 Unless otherwise expressly stated on this Site, tickets cannot be exchanged or refunded.
1.10 All purchases of tickets are also subject to our "General Admission Terms" which are set out at clause 17.
1.11 We reserve the right to refuse admission should you breach any of our "General Admission Terms" or these terms and conditions and we may on occasions have to conduct security searches to ensure your safety.
If for any reason beyond our reasonable control, we are unable to supply a particular ticket, we will not be liable to you except to ensure that you are not charged for that item.
3 Commercial Use
You represent and warrant that any tickets you purchase are for personal use only, and that they are not purchased as part of any form of for profit business or commercial activity, unless we have expressly authorised otherwise in writing.
You undertake that you will not resell or offer for resale any tickets (whether at a premium or otherwise) or use tickets for advertising or promotions (including prize draws, competitions, contests and/or sweepstakes) or for any other trade purposes. If you resell or offer for resale any tickets, then they will be invalid.
5 Cancellation and changes prior to delivery
It is your responsibility to ascertain whether a screening / event has been cancelled or rescheduled. If a screening / event is cancelled or rescheduled (for whatever reason), we will use reasonable endeavours to notify you of the cancellation or rescheduling but we do not guarantee that you will be informed of such cancellation or rescheduling before the date of the screening / event.
6.1 We may require registration with the Site in order to complete a purchase.
6.2 You must ensure that the details provided by you on registration or at any time are correct and complete.
6.3 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively.
7 Password and security
7.1 When you register to use the Site you will be asked to create a password. In order to prevent fraud, you must keep this password confidential and must not disclose it or share it with anyone. If you know or suspect that someone else knows your password you should notify us by contacting firstname.lastname@example.org immediately.
7.2 If we have reason to believe that there is likely to be a breach of security or misuse of the Site, we may require you to change your password or we may suspend your account.
8 Intellectual property
The content of the Site is protected by copyright, trade marks, database rights and other intellectual property rights. You may not reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Site without our written permission.
9 Our Liability
9.1 Subject as expressly provided in these conditions all warranties conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.
9.2 Where tickets are sold under a consumer transaction your statutory rights are not affected by any of these terms and conditions.
9.3 Any claim by you which is based on the failure of the tickets to correspond with specification must be notified to us within 7 days or (where the failure was not apparent on reasonable inspection) within a reasonable time after discovery of the defect or failure and, in any event, before the screening / event. If you do not notify us accordingly, you will not be entitled to reject the tickets and we shall have no liability for such failure.
9.4 Where any valid claim in respect of any of the tickets supplied which is based on their failure to meet specification is notified to us in accordance with these conditions, we shall be entitled to replace the tickets free of charge or at our sole discretion, refund to you the price of the tickets (or a proportionate part of the price), but we shall have no further liability to you.
9.5 We shall not be liable to you by reason of any representation, or any implied warranty, condition or other term or any duty at common law, or under the express terms of these terms and conditions, for any consequential loss or damage (whether for lost profit, lost opportunity or lost reputation or otherwise), costs, expenses or other claims for consequential compensation whatsoever (and whether caused by our negligence, our employees or agents or otherwise) which arise out of or in connection with the supply of tickets or their use or resale by you, except as expressly provided in these terms and conditions.
9.6 Our entire liability under or in connection with these terms and conditions shall not exceed the price of the tickets supplied.
9.7 Nothing in these terms and conditions will exclude or limit our liability in respect of death or personal injury caused by our negligence.
10 Availability of the Site
10.1 Although we aim to offer you the best service possible, we make no promise that the services at the Site will meet your requirements. We cannot guarantee that the services will be fault-free. If a fault occurs with the Site you should report it to email@example.com and we will attempt to correct the fault as soon as we reasonably can.
10.2 Your access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.
11 Our right to suspend or cancel your registration
11.1 We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.
11.2 You can cancel your registration at any time by informing us in writing at firstname.lastname@example.org. If you do so, you must stop using the Site.
11.3 The suspension or cancellation of your registration and your right to use the Site shall not affect either party's statutory rights or liabilities.
12 Third Party Websites
As a convenience to customers, the Site may include links to other web sites or material which are beyond our control. We are not responsible for content on any web site outside the Site.
13 Advertising and Sponsorship
Part of the Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Site complies with relevant laws and codes. We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.
14 Applicable Law
These terms and conditions and the General Admission terms will be subject to the laws of England and Wales. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.
15 International Use
We make no promise that materials on the Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom you do so on your own initiative and are responsible for compliance with local laws.
16.1 You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions to another business where we reasonably believe your rights will not be affected.
16.2 If you breach these terms and conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these terms and conditions.
16.3 We shall not be responsible for any breach of these terms and conditions caused by circumstances beyond our reasonable control.
17 General Admission Terms
17.1 The unauthorised use of photographic and recording equipment in our screening rooms is prohibited.
17.2 We accept no responsibility for any personal property on our premises.
17.3 Seating will be reserved unless otherwise specified expressly during the ordering process.
17.4 We will not be responsible for any tickets that are lost or stolen.
17.5 Latecomers to performances of any nature at Rich Mix are not guaranteed entry and will only be permitted at the discretion of Rich Mix. Latecomers that are unable to be permitted are not entitled to a refund.
